2. Service Contracting
The contracting of our services is formalized through:
- A quotation request submitted by the client
- A commercial proposal issued by Transtotal
- Express acceptance by the client (through contract signature, purchase order, or written confirmation)
- Compliance with documentary requirements according to the type of service
Each service shall be subject to the specific conditions set forth in the corresponding contract or specific document.
3. Client Obligations
The client agrees to:
- Provide truthful, complete, and up-to-date information regarding the cargo, goods, or requested service
- Submit all necessary documentation in due time and proper form for logistics and customs operations
- Comply with the legal regulations applicable to the type of goods or service contracted
- Make payments within the agreed terms and conditions
- Declare hazardous, perishable, or specially handled goods
- Obtain the necessary insurance coverage for its cargo or goods
- Timely inform of any changes in instructions or requirements
4. Transtotal’s Obligations
Transtotal agrees to:
- Provide the contracted services with professionalism and due diligence
- Keep the client informed about the status of their operations
- Comply with applicable laws and regulations in the logistics and maritime sectors
- Protect the confidentiality of client information
- Act as the client’s agent in entrusted matters
- Maintain quality standards in all processes
5. Fees and Payment Terms
Service fees shall be established in each commercial proposal or specific contract. Payments must be made according to the agreed terms, which may include:
- Advance or cash payment
- Commercial credit (subject to credit evaluation)
- Other modalities as agreed between the parties
Prices do not include taxes (VAT – IGV or others) unless expressly stated. Failure to make payments may generate default interest and suspension of services.
6. Liability and Limitations
Transtotal’s liability is limited to:
- Acts directly attributable to the Company’s negligence or willful misconduct
- The limits established under applicable sector regulations (Transportation Law, Commercial Code, international conventions)
- The insurance coverage contracted for the specific operation
Transtotal shall not be liable for:
- False or incomplete information provided by the client
- Force majeure or fortuitous events (natural disasters, strikes, armed conflicts, government restrictions)
- Acts of third parties (shipping lines, authorities, other logistics operators)
- Delays in customs or port authorities
- Hidden defects of the goods
- Indirect losses, loss of profits, or consequential damages
7. Insurance
It is the client’s responsibility to obtain the necessary insurance coverage for its cargo or goods. Transtotal may offer insurance brokerage services but assumes no responsibility for coverage not contracted by the client.
8. Confidentiality
Both parties agree to maintain the confidentiality of commercial, technical, and operational information exchanged during the contractual relationship. This obligation shall remain in force even after the termination of the commercial relationship.
9. Right of Retention
Transtotal reserves the right to retain goods, documents, or assets under its custody until all outstanding payment obligations by the client have been fulfilled, in accordance with Peruvian legislation.
10. Use of the Website
The content of Transtotal’s website (texts, images, logos, designs) is protected by copyright and intellectual property laws. The user agrees to:
- Not reproduce, distribute, or modify the content without authorization
- Use the website lawfully and in accordance with these Terms

The parties may agree to submit their disputes to arbitration in accordance with the Rules of the Lima Chamber of Commerce.
15. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Peru, including but not limited to the Civil Code, Commercial Code, Transportation Law, and applicable customs, maritime, and port regulations.
16. Severability
If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
